Functionally no, but I'm pretty sure that codes require the neutral ("return") to be uninterrupted. You should put it in the hot leg.Originally Posted by Dave Zellers

OK thanks. That's what I was wondering. It's on the neutral now and will be an easy change.
I'm replacing a broken switch and this didn't seem right.
